The meeting was held at the initiative of Laboratorios SALVAT, S.A. on the withdrawal of the document published on 14.08.2013 on the electronic portal as an annex to submission ID 3572.

The hearing was opened by the Director of the Department of Classification, Pricing and Drug Policy, PharmDr. Rastislav Pullmann, who welcomed Mrs Kormošová and invited her to present the requirements of the company that she represents.

  1. She thanked me for accepting.
  2. She asked the Ministry's representatives to withdraw the document from the electronic portal, as it contains business secrets.
  3. It referred to a number of provisions of general binding legislation which protect the interests and rights of their client and which we could accept and apply here as well.

PharmDr. Rastislav Pullmann

  1. He pointed out that the complainant had knowingly signed and transmitted the document in question, realising that it would be published on the electronic portal immediately after the transmission.
  2. The process of categorization and official pricing of medicinal products is underway by acting alone, transparently, in order to eliminate corruption in public administration.
  3. If the Ministry's Legal Department takes the view that compliance with the client's requirement does not give rise to any error in the law, damage to the reputation and transparent process of categorization, the Ministry is willing to proceed with a solution that would not jeopardise Laboratorios SALVAT, S.A. by publishing the document in question and was acceptable by the Ministry.

Conclusion:

  1. Find optimal solutions for all stakeholders.
  2. To be submitted to the section of the legislative legal analysis of Laboratorios SALVAT, S.A. represented by Monica Kormošova LL.M. for a clear opinion.
