The Department of Control and Complaints (hereinafter referred to as "ÚKAS") as the organizational unit responsible for handling complaints and petitions in the material scope of MZ SR received the documentation and found the following facts. By letter designated as "Peticia Za healthy Ružomberok - administration" Civic Association FOR HEALTHLY RUŽOMBEROK together with other civic associations mentioned in the head office of this letter announce that they petition the MZ SR in accordance with § 5d of Act No 85/1990 Coll. on petition law as amended with the requirements mentioned therein, whose provision is allegedly the responsibility of MZ SR and its controlled bodies and organisations, in particular the Public Health Office in Bratislava and the Regional Public Health Office in Liptovský Mikuláš. In the letter in question, the writers request an oral hearing of the petition.
UKAS, after assessing the content of the submission marked as "Petition as healthy Ružomberok" together with the signatures in the number of 476 in the documentary form in copies as well as the material and formal particulars in the context of the provisions of § 3 (3), § 4a (6), § 5 (1) of Act No 85/1990 Coll. on petition law as amended (hereinafter referred to as "the Law of Petitions Act") registered the present submission in the Special Report of the Registry kept on the ÚKAS as petition under the zn. Pet 4/2019, but found that the petition as well as the signature sheets do not contain the required mandatory requirements of the petition within the meaning of Articles 3 (3), 4a (6) and 5 (1) of the Law of Petitions. In accordance with Article 5 (4) of the Act on petition law, a specific letter invited the petitioner to remedy the deficiencies of the petition within the specified time limit. Patrik Lupták, OZ Za zdravný Ružomberok as a person for representation with a public authority (hereinafter referred to as the representative of the Slovak Republic) within a specified period of time corrected the deficiencies of the petition by letter received by MZ SR on 30.10.2019.
After assessing the content of the petition, the ÚKaS found that the petition was in the nature of the application and in the part relating to the materiality of the requirements for the Ministry of Public Health of the Slovak Republic as well as to the Office of Public Health of the Slovak Republic, the MZ SR, as the competent public authority, is obliged to handle the petition in question within the meaning of § 5 (6) of the Act on Petitions, in the sense that the public authority competent to handle the petition containing the application or proposal will assess its content and send a written reply together with the justification to the representative within the period referred to in paragraph 5, i.e. within 30 working days of the correction of the deficiencies of the petition pursuant to paragraph 4 in conjunction with § 5d (1) or (4) of the Law on Petitions, in which, if the petition is supported by at least 10 000 persons, it will be discussed by the competent public authority with the competent authority for the whole territory of the Slovak Republic with a representative and a petition committee.
In accordance with § 5d (1) of the Act on petition law, a joint meeting with the heads of employees of MZ SR took place at MZ SR on December 3,2019 at the State Secretary II, and The Office of Public Health of the Slovak Republic in the presence of the Head of the Slovak Republic with a representative who attended the meeting with two representatives of civil society associations who submitted the petition in question. As the petitioners stated that the petition was also submitted to several central authorities and the Slovak Ministry of Justice considered the issue of the petition to be cross-cutting, petitioners were invited to specify and specify their requirements in general in point 1 of the petition in question at the working meeting of the Slovak Republic on December 3,2019, quote: The adoption of such immediate measures by the government, local government, as well as the agent of smells and odors Mondi SCP, a. s., which will eliminate the unsatisfactory and recurrent state of spread of annoying odors, smells and other harmful substances released into the air or water from Mondi SCP, a. s. in Ružomberok and Hrboltová. in relation to the health sector.
The petitioners presented their requirements, which are priority topics for them in order to eliminate negative environmental and health impacts of Ružomberok residents, especially by Mondi SCP, a.s. He said that he sensitively perceived all negative effects on public health, whether it concerns factors from the environment or the working environment, but considered the issue to be cross-cutting. In this case, the Slovak Ministry of Health has pointed out that not all the requirements of petitioners are covered by the scope of the applicable legislation in the field of MZ SR and the Office of Public Health of the Slovak Republic, as the issue also falls within the scope of the Ministry of the Environment of the Slovak Republic and the Slovak Environmental Inspection. The topic of the joint discussion was also the written opinion of the Slovak General Hygiene addressed by letter of 12.8.2019 to the mayor of the town of Ružomberok, under which MZ SR stands. The MZ SR sees the problem posed in the petition as cross-cutting, while the health sector is in a position to point out the negative health effects of industry, but also points to the accumulation of environmental factors and does not perceive the pollution problem from only one producer of emissions. MZ SR will continue to support all efforts and activities to reduce or eliminate any negative effects or impacts on public health. We foresee better monitoring of the pressure involved on the immigrant producer so that they are not increased and, consequently, limits are set for this area, which must not be exceeded. Through all available means, the health department will try to positively influence the health situation in the region and also to proceed to bio-momitoring of the inhabitants of Ružomberok as soon as conditions are created for this activity, both professional and instrumental, as well as financial. At the same time, we see it as essential that the health status of the population should be closely monitored at regional level and, in cooperation with cities and municipalities, to develop regional/urban health policies with priorities and proposals for action for the region.
By sending a written reply to the representative of MZ SR, he considers the petition to be equipped in accordance with § 5 (6) of the Act on petition law.
