On 15.08.2025 it was transferred to the mail office of the Ministry of Health of the Slovak Republic (hereinafter referred to as "MZ SR") from the Office of the Government of the Slovak Republic by letter sp. zn. 6157-1/2025/IP-196/OPSOP dated 15.08.2025 to equipment as determined under § 5a of Act No 85/1990 Coll. on petition law as amended (hereinafter referred to as "the Act on petition law') A petition for the restoration of surgical emergency in Zlaté Moravce, submitted by the person responsible for representing the public authorities (hereinafter referred to as "the representative'). MZ SR was delivered 343 pieces of originals of petition sheets in documentary form with the designation ņ Petitions for the restoration of surgical emergency in Zlaté Moravce and printed letters with data on the persons who supported the petition in question in electronic form. The MZ SR petition, which was designated as "Petition for restoration of surgical emergency in Zlaté Moravce', submitted from the Office of the Government of the Slovak Republic, was accepted and, after considering the material and formal details of the documentation required by the Act of Petitions, registered in the Special Report of the Registry as a petition under sp. zn. Pet 3/2025, which is the nature of the request.
In view of the fact that the petition is in the nature of the application, the Ministry of the Slovak Republic, as a public authority responsible for its execution, was obliged to make a petition within the meaning of § 5 (6) of the Act on petition law, according to which, if it is apparent from the contents of the petition that the petition cannot be dealt with under § 5 (5) of the Act on petition law, the public authority competent to handle the petition containing the request or proposal will assess its content and send a written reply together with the statement of reasons to the representative within the period under § 5 (5) of the Act on petition law. In accordance with the above provision of the law on petition law of MZ SR as a public authority competent to handle the petition, he submitted the following reply to the representative.
Hospital AGEL Zlaté Moravce a.s. is a hospital of I. level, which from the point of view of § 10 paragraph. 8 of Act No. 540/2021 Coll. on the categorisation of institutional health care and on the amendment of certain laws as amended (hereinafter: Act No. 540/2021) It means that it is not part of the hospital network until its MZ SR has approved the proper or conditional allocation of additional programmes. This is due to the fact that hospitals at I. level according to the current Annex 1 Decrees No. 531/2023 Coll. on the categorization of institutional health care do not have any mandatory programmes that they must provide if they wish to be included in the network. In the case of the hospital in question, already in the case of 2023, the hospital did not apply for surgical expertise, since in the decision it was assigned only medical and internal medicine programmes, within this summer it was decided again on the hospital's requests for supplementary programmes, where the Slovak Ministry of Health did not receive the application for the hospital's surgical programmes and pursuant to § 15 (2) of Act No 540/2021 Coll. on conditional provision of supplementary programme decides the MZ SR upon request. From the point of view of optimising the hospital network, the hospital in the system performs and is to perform the primary role of follow-up and curative care, given the proximity and good access to higher-level hospitals, which provide a more comprehensive range of care, including surgical expertise.
In view of the above mentioned MZ SR cannot act in the present case because from the point of view of optimization of the hospital network, it is not its competence to order individual institutional health care providers what programme profile they have to carry out until the given provider has shown an interest in providing the given type of care. At the same time, we want to stress that for this surgical expertise according to the latest received data, the hospital AGEL Zlaté Moravce a.s. does not meet the personnel or material and technical requirements necessary for the assignment of the programme in order to provide healthcare without endangering the patient and in sufficient quality.
Finally, the classification of institutional health care and hospitals does not include urgent revenue. MZ SR does not register the request of the Provider Hospital AGEL Zlaté Moravce, a.s. for inclusion in the network of institutional health care providers who provide institutional emergency services on urgent reception.
By sending a letter to the representative of the Slovak Republic by which he communicated the result of the execution of the petition entitled "Petition for the restoration of surgical emergency in Zlaté Moravce"" he considered the petition to be equipped in accordance with the provision of § 5 (6) of the Act on petition law.
