Reason for equipment:
On 06.10.2023 they were delivered to the mail office of MZ SR by sending from Trnava self-governing region petition sheets in the original version in number 284 pcs marked as Þ Petitions for the renewal of the dialysis centre and the nephrological practice in HlohovecA letter signed by a person appointed to represent in contact with a public authority (hereinafter referred to as "the representative') was sent to MZ SR on 10.10.2023 by a referral from the Trnava self-governing region. The accompanying letter stated that the petition was signed by 4 260 persons on the signature sheets in documentary form.
MZ SR covering letter of the representative together with the annexes accepted and after assessing the material and formalities of the documentation required by the Act of Petitions found that the submission marked as Þ Petitions for the renewal of the dialysis centre and the nephrological practice in HlohovecOn 27.9.2023, together with the documentary signature sheets with the list of 4 260 persons who supported the petition in question, the petition is a petition according to the feeling of the law registered by the Slovak Republic in the Special Report of the Register under the name Pet 12/2023.
In view of the fact that the petition is in the nature of the application, the Ministry of the Slovak Republic, as a public authority responsible for its execution, was obliged to make the petition in question pursuant to § 5 (6) of the Act on petition law, according to which, if the content of the petition proves that the petition cannot be dealt with pursuant to § 5 (5) of the Act on petition law, the public authority responsible for the execution of the petition containing the application or proposal will assess its content and send a written reply together with the statement of reasons to the representative within the period under § 5 (5) of the Act on petition law.
In accordance with the above provision of the law on petition law of MZ SR as a public authority competent to handle the petition, he submitted the following reply to the representative.
MZ SR revoked the above authorisation at the request of the provider, which MZ SR delivered according to ust. Article 19 (1) (a) (a) Act No. 578/2004 Coll. on healthcare providers, health workers, health professional organisations and amending certain laws as amended (hereinafter referred to as "Law No. 578/2004') The authority responsible for issuing the authorisation shall revoke the authorisation if the holder of the authorisation requests the withdrawal of the authorisation; the application for revocation shall be lodged by the holder of the authorisation at least two months before the date on which the authorisation is sought to cancel.
MZ SR is not authorised to grant permission to the provider to operate the nephrological practice in the specialization field of nephrology at the place of operation Podzámska 16, 920 01 Hlohovec and the permission to operate the stationer in the specialization field of nephrology at the place of operation Podzámska 16, 920 01 Hlohovec on its own initiative.
MZ SR is authorised to issue permission for the operation of nephrological ambulance in the specialization field of nephrology at the place of operation Podzámska 16, 920 01 Hlohovec and permission to operate a stationer in the specialization field of nephrology at the place of operation Podzámska 16, 920 01 Hlohovec in case the provider addresses the MZ SR application for the permission to operate the above mentioned medical facilities and meets the conditions for the issue of the permit pursuant to § 12, § 13 and § 17 of Act No. 578/2004 Z. z. z.
MZ SR is authorised to issue permission for the operation of nephrological practice in the specialization field of nephrology at the place of operation Podzámska 16, 920 01 Hlohovec and permission to operate a stationer in the specialization field of nephrology at the place of operation Podzámska 16, 920 01 Hlohovec even if another health care provider or other natural or legal person who is not a health care provider, addresses the MZ SR application for permission to operate the above mentioned health facilities and meets the conditions for authorisation pursuant to § 12, § 13 of Law No. 578/2004 If health care is provided in several self-governing regions. Another healthcare provider or other natural or legal person who is not a healthcare provider shall address an application for authorisation to operate the above-mentioned health facilities to the Trnava self-governing region if the healthcare is provided only in the Trnava self-governing region. The Trnava Self-Governing Region will grant to another healthcare provider or other natural or legal person who is not a healthcare provider permission to operate the above-mentioned medical facilities after the conditions for authorisation under § 12, § 13 of Act No. 578/2004 are fulfilled. By sending a letter to the MZ SR informing the representative of the outcome of the petition with the name the petition for the renewal of the Dialysis Centre and the Nephrological Ambulance in Hlohovec, considers MZ SR petition to be provided in accordance with the provisions of § 5 (6) of the Act on petition law.
