The Ministry of Health of the Slovak Republic pursuant to § 11 and 20 of the Act No. 18/1996 Coll. on Prices, as amended, provides:

Measure No 07045/2003 of the Ministry of Health of the Slovak Republic of 30 December 2003 laying down the scope for regulating prices in the field of health (communication No 588/2003 Coll.), as amended by measure No 07045-2/2004-OAP of 25 February 2004 (communication No 130/2004). Z. z.), measures of 20 April 2004 No 07045-3/2004-OAP (Communication No 253/2004) Z. z.), measures of 3 August 2004 No 07045-4/2004-OAP (Communication No 474/2004 Z. z. z.) and the measures of 23 August 2004 No 07045-5/2004OAP (Communication No 487/2004) Z. z.) is amended as follows:

(1) The maximum prices for sales from a domestic producer or a foreign supplier are set out in Annex No. 2.
(2) The maximum prices are including import duties and transport costs to the warehouse of the domestic customer or the customs warehouse, the maximum prices being net of value added tax (hereinafter referred to as "Taxation').
(3) For the purpose of regulating sales prices from the domestic producer, a reasonable profit of up to 30% of the economically eligible costs shall be determined.
(4) The conditions for price regulation are set out in Annex 3.
2. Mass-produced medical devices
Diopter lenses for spectacles, of glass and other materials, materials for diopter and glasses, contact lenses and spectacle frames, excluding individual contracts, medical prescription only
(1) The maximum prices for sales from a domestic producer or a foreign supplier are set out in Annex No. 2.
(2) The maximum prices are including the cost of transport to the warehouse of the domestic customer and possibly the customs warehouse, import duty, while the maximum prices are without tax.
(3) For the purpose of regulating sales prices from the domestic producer, a reasonable profit of up to 30% of the economically eligible costs shall be determined.

(2) The maximum prices referred to in paragraph 1 shall be calculated and applied to the prices actually charged to domestic producers or foreign suppliers, including import duties and transport costs, the maximum prices being tax-free.
(3) Where more than one person participates in the circulation of goods, the total price of the commercial performance shall be agreed up to a maximum of the maximum price referred to in paragraph 1.
(4) Where the distributor supplies the products referred to in paragraph 1 directly to the medical establishment in which they are consumed, the price of the commercial performance shall be agreed up to a maximum of the price referred to in paragraph 1 for the distributor. Where the manufacturer delivers the products referred to in paragraph 1 directly to a pharmacy care facility, the price of commercial performance shall be agreed without the price referred to in paragraph 1 for the distributor.
