The definition of unjustified wage expenses by the managing authority is as follows: "Working commitments of persons working on a project shall not overlap; it shall not be permissible for an employee to be paid for the same activity at the same time or for the same outputs several times. The expenditure relating to these working statements will be excluded from the financing of the project/projects concerned at the level of the relevant day, and it is not relevant on the basis of which contractual relationship the person worked. When the expenditure overlaps the project, the provider is entitled to withdraw from the NFP's contract.
If part of the wage, e.g. 2/3 of the ADOS user, MOHO is paid from the project resources and the beneficiary is entitled to pay only for those 2/3 and e.g. 1/3 paid from other sources e.g. public insurance, it is not an overlap.
Frequently Asked Questions and Answers to the Call for a National Project
1. What is the crucial period for assessing the amount of eligible compensation?
The duration of the main activity of the project is specified until 31.12.2023. In order to determine the amount of compensation, the period from the entry into force of the Cooperation Treaty to 31.12.20223 for this project will be taken.
2. What does it mean that users are entrusted with the operation of SGEIs by the Cooperation Treaty for the period until 31.12.2028?
In accordance with Article 9. Specific arrangements, point 9.1. (c) The period of the SGEI commitment is determined from its date of validity and effect until 31.12.2028. That period shall cover the obligation for the user to keep accounting documentation, payroll and other documentation relating to the project, the use of NFP (e.g. market research) and the provision of services financed by the NFP until at least 31.12.2028. This provision also regulates the period for which the recipient of the aid is entrusted with the provision of SGEIs pursuant to Article 2 (2) of the Commission Decision.
3. Are the receipts from health insurance undertakings considered to be an income for the performance of SGEIs under the Cooperation Agreement?
For the purposes of the State aid scheme and the financing of projects, the service of general economic interest (SGEI) was designated as a service related to the provision of long-term health care and palliative care in an outpatient health care facility pursuant to Paragraph 4 (1), Paragraph 7 (1) (a). (a) and (d), Paragraph 8 of Act No 576/2004 Coll. on health care, services related to the provision of health care and the amendment of certain laws as amended; and therefore, if the entire activity of the establishment falls within the above-mentioned service (the SGEI service), the calculation and control of the amount of compensation for SGEIs must include all the costs and revenues of the service provided, i.e. the proceeds/revenue from the payments from health insurance companies for the services provided by the facility. This revenue is entered in Annex II, part Revenues/revenues for the performance of an SGEI service, point 2.1 Turnover from sales of services (accounting for: 602 payments/insurance companies).
4. Is a reasonable profit taken into account when determining the amount of compensation?
According to the methodology for setting the amount of compensation (ANNEX I and II), the amount of compensation is not taken into account for a reasonable profit, the compensation is granted only up to the net cost of the SGEI in question. At the same time, the methodology set out by the provider takes into account the above-mentioned conditions and the amount of the eligible SGEI compensation is calculated according to the formula: The amount of the eligible compensation = SGEI costs - SGEI revenue - SGEI revenue, the revenue being considered as SGEI revenue (all financial resources/revenues) within the duration of the entrustment. In general, overcompensation is/is positive in the profit or loss (the profit or loss should not be > 0).
In general, it can be stated that the public aid scheme for services of general economic interest is defined as a compensatory/ compensatory payment by the State to ensure fulfilment of the obligation (at zero), i.e. support for financing or financing the costs incurred or expected costs not covered by the beneficiary, but incurred in order to enable the service to be performed/secured. The purpose of state aid, but also ESF support, is to finance the cost structure, i.e. reimbursement of costs, not making provisions for future expenditure and investment.
5. In which line of Annex II. Schemes should the non-refundable financial contribution for SGEI performance be included?
A non-recoverable financial contribution may be included in the following items, according to which the entity shall account for them in terms of legal form and method of accounting:
2.5. Subsidies/revenues under NFP (current transfers)
2.13. Other revenues related to SGEI services
The non-recoverable financial contribution must be included in the income/benefits due to control and verification of overcompensation.
6. Is analytical accounting necessary, creating a cost centre for the project?
The user undertakes to account for the facts relating to the project in the analytical accounts broken down by funding source, whether in the form of cost centres or in the form of analytical records, so that expenditure and costs covered by the NFP are easily and quickly allocated to the source of funding and there is no multiple funding from different sources (e.g. public health insurance funds, funds from the founder, donations, etc.) or in the analytical records kept in technical form broken down by project without the creation of analytical accounts broken down by project if charged in the system of double accounting. In the light of the above, it is necessary to set up cost centres or sub-accounts for the project in order to monitor the absorption of funds for the project.
7. Is the non-repayable financial contribution paid under the Cooperation Agreement considered to be taxable income which the user must include in the corporate tax return and total income for 2023?
As defined in point 4.3. (e) Cooperation contracts must be consistent with the provisions of this contract, all legal documents, as well as Slovak and EU legislation. The general legislation governing the uniform application of income tax to a natural or legal person and the manner in which the tax is paid and collected is governed by Act No 595/2003 Coll. on Income Tax.

The fact that MZ SR, NFP provider or other qualified entity will in exceptional cases require repayment of funds will be able to be assessed only after completion of the project.
In the event that the entity received an SGEI contribution/compensation and ceased its activity during the project, it will be necessary to check overcompensation in accordance with Annex I, II. State aid schemes to support the strengthening of long-term health care and palliative health care (State aid scheme in the form of compensation for services of general economic interest No SPA OF SGEIs For the financial year for which compensation for SGEIs has been granted, verification must be carried out.
